Tomed strives to make your buying experience as trouble free as possible. It is our objective to treat our customers the same way as we would like to be treated when we buy online.
To make your buying experience with us as smooth and risk free as possible, we have put together these specific e-commerce terms & conditions. If you are unsure about any of these, please contact us preferably by email, phone or fax with the contact details listed at the bottom of this page.

Minimum order volume amounts for EUR 25.00.
Payment by GlobeCharge global internet payment services
We are cooperationg with the globally active GlobeCharge internet payment services. With GlobeCharge you can easily pay by your credit such as AMEX, MASTERCARD or VISA. When you place your order we will be informed normally within minutes about your payment by GlobeCharge. You will receive a payment confirmation by them too. After confirmation of your payment we will then release your order within the next two working days.
Notes on Delivery
We are used to hold sufficient stock of all items advertised on this web page. If for any reason items are not in stock, you will be informed of this and advised of when delivery can take place. If this is not satisfactory, you have the option of cancelling your order, and we will fully refund you.
All orders received will be normally shipped within the next two working days (as stated above).
Applicable shipping charges for small volume webshop orders are as follows:
- Germany: € 7,14
- E.U. countries apart from Germany: € 9.00
- European non-E.U. countries: € 11.00
- Rest of the World: € 15.00
Please note, we use at our discretion both (express) airmail and couriers, depending on destination and actual cost of shipment. .
Distance selling policies and refunds
Generally you have the right to cancel the order contract by giving us notice in writing, including fax or email at any time within 7 working days after the day of receipt of the goods.
When sending goods back it is recommended to use recorded delivery. We cannot be held responsible for non-delivery of returned goods. Please be aware that postage & packaging charge is not refundable. You will not be charged again for delivery, if any part of the order is due to an error on our part.
In case of order cancellation we will refund only the cost of goods without any freight charges you have paid for. However, we will make a EUR 16.00 administration charge. This condition also applies to those individuals who inadvertently place two orders and wish to receive a refund.
The aforementioned return policy also applies if goods are rejected at your national customs for whatever reasons (e.g. infringement of national regulatory reasons for medical products) and are therefore returned to Tomed.
In some countries our products are considered as medical products. Due to this very special nature of our products we will not refund any goods that have been opened and/or used. We reserve the right to refuse return of items which are not in a saleable condition.
Our oral appliances for treatment of snoring and obstructive sleep apnea are 510(k) cleared by the FDA in the U.S.A. They can only be dispensed there following a doctor's prescription. We will therefore serve orders from authorized U.S. medical professionals or medical companies only, but not serve any private orders from the U.S. without having obtained before a presription either by fax or by email as a PDF in order not to infringe U.S. medical law. The prescription must list the official address of the prescribing medical professional. Ordered goods will then be shipped to the prescriber's address only. In case of private oral appliance orders from the U.S. prepaid by credit card, but without a prescription, we will make a refund, however withdraw a EUR 16.00 administration charge.
We encourage U.S. medical professionals or medical companies to contact us by email, phone or fax for our special reseller conditions before placing an order at our web site!
Any items outside the 7 working days' return period after the day of receipt of the goods cannot be accepted under any circumstances due to the medical nature of the products, and any received products outside this stated period are destroyed, and not retested for returning back into stock.
We do not offer any products for sale on a trial basis.
VAT
VAT is included in all prices quoted in the Tomed Onlineshop. For goods sent outside the E.U. geographic area VAT will be deducted from the quoted prices. There is no VAT to be added for countries not in the E.U.
For items purchased from EU countries VAT will be charged at the rate of 19.0% as applicable for Germany.
Security:
When you view your shopping basket or proceed to check out, all the information is protected against disclosure to third parties, as this is carried out in a secure part of our website. Security is guaranteed by our internet payment provider GlobeCharge.
Applicable Law
The laws of Germany and the European Union will govern all terms, conditions and disclaimers on this site, without giving effect to any principles of conflicts of laws.
